Charge raised to aggravated assault in Smith bashing

The man accused in the Sep 27 alleged gaybashing of Jordan Smith arrived for his third court appearance Oct 14 to discover the charge against him had been upgraded to aggravated assault.

Michael Kandola, 20, sat quietly at the back of the courtroom, his hand shielding his face from the view of onlookers and media.

He would not comment on the charge as he left court, walking quickly to a waiting car while trying to dodge media cameras.

Smith, 27, was walking along Davie St hand-in-hand with another man when a group of four young men allegedly approached them, according to police.

The men allegedly screamed obscenities about the couple’s sexual orientation, then knocked Smith unconscious with a punch to the head.

Police say Smith fell to the ground at the corner of Davie and Hornby Sts.

His jaw was broken in three places and had to be wired shut to heal.

Police want the incident prosecuted as a hate crime because of the obscenities allegedly uttered before the attack.

“Fabulous,” says community activist Jim Deva when told of the new, more serious charge of aggravated assault. “I think that’s where it needs to be.”

The Centre’s executive director, Jennifer Breakspear, agrees.

“I’m pleased to see that the Crown is giving the situation the gravity it deserves,” she says.

“I hope the Crown is doing its due diligence so that we don’t see a hate crime designation fall through the cracks for any reason,” she adds.

Crown spokesperson Stan Lowe says the decision to upgrade the charge came as a result of a review of medical evidence in the case.

“Our decisions in these cases are always driven by the evidence available,” he says.

As for seeking a hate crime designation, Lowe explains that if the evidence suggests hatred played a part in the alleged assault, the Crown will introduce that evidence at trial. The Crown would then “invite” the court to consider that hatred as an aggravating factor at sentencing, if the accused is convicted.

According to the Criminal Code of Canada, a person convicted of a crime should get a stiffer sentence if there's evidence their actions were motivated by “bias, prejudice or hate” based on sexual orientation or other grounds.

Kandola returns to court Oct 27, possibly for arraignment on the charge, says Lowe. What happens after that depends on what plea Kandola enters at that time.

Kandola’s new bail conditions remain the same as before. He is to have no contact with the victim and stay out of the Davie Village area.

“Don’t prejudge the case,” warns Kandola’s lawyer Danny Markovitz. "Let’s wait and see.”

Markovitz says a tape of the incident from surveillance cameras at the 7-Eleven store at the corner of Davie and Hornby “isn’t exactly consistent with what the complainant is saying.”

Told of Markovitz’s comments about the videotape, Deva shrugs.

“That’s his job,” Deva says. “Create doubt.”

Vancouver Police Department spokesperson Insp John McKay has said the situation could have been worse had it not been for the intervention of witnesses who stopped and told the attackers they were calling the police.

“There’s no doubt in my mind that this assault was going to continue based on the behaviour they all said occurred,” McKay told reporters at a press conference Sep 28.

McKay says the group of alleged attackers fled but was found in an alley a block away.

Kandola was arrested and taken into police custody. There have been no other arrests related to the incident.

This upgraded charge makes me very happy, I just hope there is no doubt and he is found guilty. I hope Jordan has been 100% truthful with us though...

This was a targeted act.
Why were Indo Canadian men in the Davie Village in the first place. Personally I have heard conversations on the Skytrain such as 'lets go kill some fags' and similar statements I have heard this many time and all are Indo Canadian men and all are under 25, maybe there should be focused education to them as its not happens as much in other communites. I personnally have witnessed many time Indo Canadian men taunting me and other gay men just for fun. Maybe they need to be better Educated and understand there a minority too how would they like the 'KKK' to go to there Community and start bashing them. They also tend to target women mostly White, black and Asian women since there culture frounds on raping there women I wish they would get it that just becasuse they are in a group bashing anyone is wrong. Personnally I call for a total boycott of Indo Candian men from bathhouses, parks, bathrooms and such. If they going to use the gay community its not okay to bash us after you get your rocks off. I have posted the same statement in a local paper. I call for a all out boycott of Indo Candian men at all gay sex places, they know who they are lets not be fooled they use the services of gay men I have seen many at a few bathhouses and down a few trails, they know who they are, but not anymore.

Hmm. No one of any background or lifestyle should ever be beaten up. I too hope Mr. Smith has been 100% truthful. What I also wonder is how come this incident got so much media coverage, yet another man a couple weeks earlier also got beaten up very bad near the corners of Burrard and Davie but received little to no media attention. Could it be because he is in his mid 40's of average build and looks?

Racism won't help anything
Basil Fitze-- your comment doesn't help anything. The cause of gay-bashing is homophobia, which is alive and well in most cultures, not least in white Canadian culture. How disgusting and hateful to blame South Asian people as a whole for this incident and to suggest banning them from bathhouses, etc. It's so sad to see this kind of attitude.

Sentence should require promoting tolerance
I think whatever sentence this guy gets should require him to do educational seminars at his local high schools that promote tolerance AND acceptance of homosexuals in society. Maybe it might even help him to come to terms with his own anger towards homos...

Not so innocent
As a gay man, I keep hearing from others that Jordan Smith does have quite the smart ass mouth on him. Could that be the reason he was hit in the mouth area? Not that anyone should be beaten for any reason but why do I keep hearing that Jordan was not so innocent in this situation? Now the video supports that story in a sense too. Guess we'll see what happens. When you are high, and coming from The World at 4am, horny and thinking you are about to get it on with the anonymous guy you picked up, its best to watch your back. Hell, we have to watch our backs at the best of times. No one deserves to be beaten up. Guess I am just worried about how us gays conduct ourselves when under the many influences available. Seems to be so rampant these days. Low self confidence levels?

Is Michael Kandola related to alleged cocaine dealer Robert Kandola who was murdered in 2002? Will Xtra-West attempt to find out what may have motivated Kandola to attack Smith? What could have caused his anger? Further, what's to stop West End gay vigilantes turning the tables and knocking down a few Surrey IndoBigots at Guilford Mall in retaliation?

EVERYTHING is to stop gay vigilantes from attacking "a few Surrey IndoBigots" (holy racism batman!) Violence will not solve anything - it's called escalation. Although maybe you also think that the American war in Iraq is justified too. Not to mention ethnic profiling...(because that's exactly what you're doing) There are people of all backgrounds that are hateful and bigoted - you've just proven it.
