Malawi's president pardons jailed queer couple

After a meeting with the UN Secretary General on Saturday, Malawian President Bingu wa Mutharika has ordered the release of a queer couple jailed under the country's sodomy and indecency laws.

The president said the couple committed "a crime against our culture, our religion and our laws." More from the UK Telegraph:

"However, as the head of state I hereby pardon them and therefore ask for their immediate release with no conditions."

He added: "I have done this on humanitarian grounds but this does not mean that I support this."

On May 20, a judge in Malawi sentenced Steven Monjeza and Tiwonge Chimbalanga to 14 years in prison with hard labour. The two were arrested in December 2009 after they held a symbolic engagement ceremony. Monjeza and Chimbalanga were convicted of "unnatural acts" and "gross indecency."

UN Secretary General Ban Ki-moon is also expected to address Malawian legislators and ask for changes to the country's anti-homosexuality laws, reports the Telegraph.

Again Xtra fails to mention that this is in fact a heterosexual relationship between a cis man and a trans woman. It is erroneous (and humilating/hurtful) of both the Malawi government and xtra to *ACTIVELY* not acknowlege Tiwonge Chimbalanga's female identity/lived experience. For further journalistic standards regarding trans people, I refer XTRA to The Associated Press Stylebook recommendations for covering transgender people, under "sex changes" in the 2000 edition:

"Use the pronoun preferred by the individuals who have acquired the physical characteristics (by hormone therapy, body modification, or surgery) of the opposite sex and present themselves in a way that does not correspond with their sex at birth.

If that preference is not expressed, use the pronoun consistent with the way the individuals live publicly." For more info: http://www.transgenderlaw.org/press.htm

Of course you're right, Kate. This story broke using the words 'gay couple', and the error was never corrected even after we knew that Tiwonge is a trans.

As for the release, well, yea, it really is good news, but I still think they never should have been arrested in the first place. If there was a crime, where is the victim?
